AbillproposedintheTexaslegislaturecouldchargetransgenderTexanswithastatefelonyiftheycommitwhatproponentscall“genderidentityfraud.”
RepublicanstateRep.TomOliverson,whorepresentsapartofHoustoninDistrict130,introducedHouseBill3817thatwouldamendtheTexasPenalCodetoaddanewformoffraudrelatedtogenderidentity.
Accordingtothebill,“genderidentityfraud”wouldbecommutedifaperson“knowinglymakesafalseormisleadingverbalorwrittenstatementtoagovernmentalentityortheperson’semployerbyidentifyingtheperson’sbiologicalsexastheoppositeofthebiologicalsexassignedtothepersonatbirth.”
Thepenaltyifsomeoneweretocommit“genderidentityfraud”wouldbeastatefelony,whichcouldlandapersoninprisonforuptotwoyearsanda$10,000fine.Thebillisnotexpectedtopass,accordingtotheTexasLegislaturetracker,asithasnoco-sponsorsandhasnotmovedtoanycommittees.
